1. Who we are and what we do

BANSO SOLUTIONS LTD., operating as BANSO SOLUTIONS, is a money services business registered with FINTRAC (No. N300001386) and incorporated in British Columbia (No. BC1531883). We exchange currencies, send and receive international payments and buy and sell digital assets over the counter. Crowdfunding platform services and payment services for merchants are provided only under a separate written agreement.

We are not a bank. We do not take deposits, pay interest or lend. We do not give investment, tax or legal advice, and nothing on this website is a recommendation to buy or sell any currency or digital asset. We do not hold client assets for trading.

2. Becoming a client

  • Before your first operation we verify your identity, and for a business its directors and beneficial owners, as the Proceeds of Crime (Money Laundering) and Terrorist Financing Act requires. We may ask for more documents at any time, including the source of your funds.
  • The information you give us must be accurate and complete, and you must tell us when it changes.
  • We may decline to open a relationship, or end one, at our discretion and without giving reasons, subject to completing any operation already agreed where the law allows.
  • Our services are for adults, 19 or over in British Columbia, and for businesses acting through authorised people.

3. Quotes

Indicative quotes. The prices shown by the tools on this website are built from live market reference rates plus our margin for the amount entered. They are indicative only, may change at any moment and do not commit us or you.

Firm quotes. A firm quote is one we send you in writing, by email or another channel we have agreed. It states the rate, our fee, the value date and the time for which it is valid, currently 15 minutes from the moment you accept it. Accepting a firm quote creates a binding order for both of us.

4. Funds and cut-off

  • Your funds are due in our account by the cut-off stated on the firm quote, currently 14:00 Pacific on the value date. We work by bank transfer only: no cash, no cheques.
  • Funds must come from an account in your own name, or in the name of the business you act for. We return funds received from anyone else, less bank charges.
  • If your funds do not arrive by the cut-off we may cancel the order. If we have already covered your order in the market and the market has moved against us, the difference and any costs are charged to you.

5. Payments and delivery

  • We pay to the beneficiary details you give us. Check them: a payment sent to an incorrect but valid account on your instructions cannot be recalled unless the receiving bank agrees, and we are not responsible for losses caused by wrong details.
  • Arrival times are estimates. Intermediary and beneficiary banks, public holidays abroad and compliance checks along the route can add days and are outside our control.
  • Our fee is disclosed on the quote. Charges taken by intermediary or beneficiary banks along the route are not ours and may be deducted from the amount received.
  • A payment returned by the beneficiary bank is credited back to you less the bank charges incurred; our fee for an executed payment is not refunded.

6. Digital assets

  • Delivery to the wallet address you provide is final. An address you gave us that is wrong, mistyped or on the wrong network cannot be reversed, and the assets are lost. We may ask for a small test transfer first.
  • Network fees are passed through at cost and shown on the quote.
  • Digital assets are volatile and are not covered by deposit insurance. The risk of price movements between your instruction and settlement, once a firm quote has expired, is yours.
  • We do not hold, stake, lend or manage your assets. We may refuse to deal with wallet addresses that our screening links to sanctioned, illicit or high-risk services.

7. Compliance, refusal and delays

We may delay, suspend, decline or report any operation when the law, a regulator, a bank or our own risk assessment requires it, and we may be prohibited from telling you why. We are not liable for losses caused by such delays or refusals made in good faith.

8. Fees and pricing

Our margin is included in the rate we quote and our fee is a separate line. Both appear on every firm quote before you accept. Fees paid for an executed operation are not refundable. Taxes, if any, are added where the law requires.

9. Your obligations

  • Use our services only for lawful purposes and with funds that belong to you or to your business.
  • Give us accurate instructions and check every confirmation we send. Tell us of any error as soon as you notice it.
  • Keep your email account and any credentials you use with us secure, and tell us at once if you suspect misuse.

10. Our liability

To the extent the law allows, our liability for any operation is limited to direct loss and to the amount of that operation. We are not liable for indirect or consequential loss, lost profit or opportunity, or for events beyond our reasonable control: failures of banks, payment networks or blockchains, government action, outages or force majeure. Nothing in these terms excludes liability that cannot be excluded by law, including your rights under consumer protection legislation.

11. Communications and security

Email is our channel for quotes, confirmations and notices. Our official addresses end in @banso.solutions, our only telephone number is +1 672-800-1505 and this website is our only website. We never ask for passwords, never ask you to move money or digital assets by telephone to an address we have not confirmed in writing, and never change our bank details by email without a call-back. If you receive a message that looks like ours and does not match this, do not act on it and write to office@banso.solutions.

12. Cancellation and close-out

Once you have accepted a firm quote we cover it in the market. If you cancel, fail to fund the order or otherwise do not complete it, we may close out the order at the market rate then available. Any difference between the price you accepted and the close-out price, and any costs we have incurred, are charged to you; any gain stays with us as compensation for the risk taken.

13. Set-off and retention

We may hold back funds or assets we are due to deliver to you, and set them off against any amount you owe us, including close-out differences, returned-payment charges, fees or losses we have suffered because of your breach of these terms. We tell you when we do so.

14. Errors and time limits

  • Check every confirmation we send. If you do not tell us in writing of an error within 30 days of the confirmation, the operation is deemed correct and accepted.
  • If we credit or deliver to you more than you were due, by error, you must return the excess on request. We may recover it by set-off.
  • If we have made an error, we correct it at no cost to you. Our liability for it remains as set out in these terms.

15. Indemnity

You indemnify us against losses, costs, claims and expenses, including reasonable legal fees, that we suffer because of information you gave us that was false or incomplete, instructions you gave us that were wrong, or a breach of these terms or of the law by you or by someone acting for you. This indemnity does not apply to losses caused by our own negligence or breach.

16. Sanctions and lawful conduct

You declare, each time you deal with us, that neither you nor any beneficial owner, director or beneficiary of your operation is a person listed under Canadian, United Nations, United States, United Kingdom or European Union sanctions, and that you are not acting for such a person or for the benefit of a sanctioned country. You also declare that the funds and assets you use come from lawful activity. A false declaration entitles us to end the relationship and to report as the law requires.

17. Records of communications

We keep our emails, messages and, where we tell you, recordings of telephone calls with you, for compliance, security and as evidence of instructions, for at least five years. Our records are the reference in case of dispute unless proven wrong.

18. This website and market data

The website and its tools are provided as they are. Reference rates come from third-party sources, may be delayed or wrong, and are shown for information only: the only price that binds us is a firm quote. We may change or interrupt the website at any time and we are not liable for its unavailability. The content, design, logo and text of the website belong to us and may not be copied without permission.

19. Digital-asset events

Once assets are delivered to your wallet, everything that happens to them afterwards is yours: forks, airdrops, staking rewards, token migrations and losses alike. We owe you nothing from such events, before or after delivery, unless the firm quote says otherwise. You are responsible for the wallet and for keeping its keys safe, and for confirming that the network we agreed is the one your wallet supports.

20. Electronic communications

You agree that quotes, acceptances, confirmations, notices and these terms may be sent, accepted and stored electronically, and that an email or an electronic acceptance from the address or channel we have on file for you has the same value as a signed document.

21. General

  • We may assign or transfer our rights and obligations under these terms to a successor of our business; you may not assign yours without our written consent.
  • If we do not enforce a right at once, we do not give it up.
  • These terms, the privacy policy, the complaints procedure and any written agreement we sign with you are the whole agreement between us. If they conflict, a signed agreement prevails.
  • These terms are written in English; a translation is for convenience only and the English text governs.

22. Privacy and complaints

How we handle personal information is described in our privacy policy. If something goes wrong, our complaints procedure explains what to do and what we do next.

23. Changes to these terms

We may change these terms by publishing the new version on this page with its date. An operation is governed by the terms in force when its firm quote was accepted.

24. Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia have jurisdiction. If any part of these terms is found invalid, the rest remains in force.
